WHAT IS A POWER OF ATTORNEY?


A power of attorney is a document in which you state that you give someone else (someone related or a friend) the authority to make certain decisions and act on your behalf. The person to whom you give these powers is called an “agent” or “attorney-in-fact.” You are called the “principal.” Just because the word attorney is used does not mean that the person you give authority to has to be a lawyer.

ORAL AND WRITTEN POWER OF ATTORNEY


A power of attorney may be oral and whether witnessed or not, will hold up in court, the same as if it were in writing. For some purposes, the law requires a power of attorney to be in writing. Many institutions, such as hospitals, banks and, in the United States, the Internal Revenue Service, require a power of attorney to be in writing before they will honor it, and they will usually keep an original copy for their records. In some countries and situations, an Electronic Power of Attorney can also be considered valid.

By establishing a power of attorney, you are giving someone of the following powers:

  • To spend your money, cash checks, and withdraw money from your bank accounts
  • To sell your property
  • To enter into contracts on your behalf
  • To pursue insurance claims and legal actions
